1. Seller and contact details

The seller and contractual counterparty is Hartington Pharmaceutical S.L.U., Company Tax Code B63437735, registered in the Company Register of Barcelona, Volume 36349, Folio 196, Page B-285983.

2. Scope and contract formation

These Terms apply to consumer purchases made through nasodren.com. Product descriptions, the price, available delivery destination, delivery charge and available payment methods are shown before the order is submitted. An order is accepted when Hartington sends the order confirmation or dispatch confirmation, subject to payment authorisation and stock availability.

Nothing in these Terms limits mandatory consumer rights that apply in the consumer’s country of residence.

3. Product information

The approved product information and Instructions for Use are available on the product page. The product must be used in accordance with those Instructions for Use. Website information does not replace advice from a qualified healthcare professional.

4. Prices, taxes, invoices and payment

Prices and delivery charges are displayed in euros and include applicable taxes where stated. The complete amount payable is shown before the order is placed. Any currency-conversion or issuer charge applied by the customer’s bank or payment provider is outside Hartington’s control.

Available payment methods may include card payment through Redsys / 3D Secure and PayPal. Payment providers process the payment information needed for the selected method. Hartington does not store full payment-card details.

An invoice or order receipt will be provided electronically. Customers should contact orders@hartington.org if invoice information needs correction.

5. Delivery

Delivery is available only to destinations offered at checkout. Estimated delivery periods and charges are displayed during checkout. Business-day estimates exclude weekends and public holidays and are estimates rather than guaranteed delivery dates unless Hartington expressly agrees a fixed date.

Hartington remains responsible for loss or damage in transit until the consumer, or a third party nominated by the consumer other than the carrier, takes physical possession of the goods. If the consumer independently appoints a carrier that Hartington did not offer, risk transfers when the goods are handed to that carrier.

Customers should report a delay, loss or damage promptly to orders@hartington.org, quoting the order number. Hartington will handle the matter with the carrier; the customer is not required to pursue Hartington’s carrier directly.

6. Cancellation before dispatch

A customer may request cancellation before dispatch by contacting orders@hartington.org. Hartington will act on the request where dispatch can still be stopped. If the order has already been dispatched, the statutory withdrawal procedure below remains available where applicable.

7. Consumer right of withdrawal

Where the statutory distance-sale withdrawal right applies, the consumer may withdraw without giving a reason within 14 calendar days from the day the consumer, or a third party nominated by the consumer other than the carrier, takes physical possession of the goods.

To exercise the right, the consumer must send a clear statement before the deadline. The consumer may use the Returns and withdrawal form, email orders@hartington.org, or write to Hartington at the postal address above. Use of the website form is optional.

After notifying Hartington, the consumer must return the goods without undue delay and no later than 14 calendar days after sending the withdrawal notice. Unless Hartington agrees to pay them, the consumer bears the direct return cost. Hartington bears return costs for incorrect, damaged or non-conforming goods.

Hartington will reimburse payments received, including the cost of the least expensive standard delivery option offered for the order, without undue delay and no later than 14 calendar days after receiving the withdrawal notice. Hartington may withhold reimbursement until the goods are received or the consumer supplies evidence that they were sent back, whichever occurs first. Reimbursement uses the original payment method unless the consumer expressly agrees otherwise and will not incur a reimbursement fee.

The consumer is responsible only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The withdrawal right does not apply to sealed goods that are not suitable for return for health-protection or hygiene reasons once they have been unsealed after delivery, but only where all statutory conditions for that exception are met. This exception does not limit rights relating to defective, damaged, incorrect or otherwise non-conforming goods.

8. Return address and instructions

Returns should identify the order number and be sent to: Hartington Pharmaceutical S.L.U., Attn: Returns, Avda. Ernest Lluch 32, Tecnocampus Mataró – Torre TCM3, Floor 6, Door 3, 08302 Mataró, Barcelona, Spain. Customers may contact orders@hartington.org before sending a return so Hartington can provide handling instructions; prior authorisation is not required to exercise a statutory withdrawal right.

9. Damaged, incorrect or non-conforming goods

Customers should contact orders@hartington.org with the order number and a description of the issue. Statutory remedies for non-conforming goods are provided without charge. Depending on the applicable circumstances, these may include replacement, price reduction or refund. Under Spanish consumer law, Hartington is responsible for a lack of conformity in new goods that exists on delivery and becomes apparent within three years from delivery. Mandatory rights under another applicable consumer law remain unaffected.

10. Complaints

Complaints may be sent to orders@hartington.org or the postal address above. Hartington will acknowledge and assess the complaint using the order and contact information needed to resolve it.

11. Personal data

Personal data used for orders, delivery, payments, returns and support is processed as described in the Privacy Policy. Cookie choices are described in the Cookie Policy.

12. Applicable law

These Terms are governed by Spanish law. This choice does not deprive a consumer of mandatory protections that apply under the law of the consumer’s habitual residence. Any dispute may be brought before the courts competent under applicable consumer law.
